Aquarium Rental Agreement

(1) Enquiry to agreement.

Springs Aquatic will carry out a free no obligation on-site visit to asses all the options open to the Hirer.

Once Springs Aquatic has agreed to hire out an Aquarium to the Hirer and the Hirer agrees to the Terms and Conditions of this Contract, a £75 deposit, will be required.

Upon receipt of the deposit, Springs Aquatic will then order for immediate delivery the agreed Aquarium package. A date for installation will be set and agreed between the Hirer and Springs Aquatic at this time or as convenient.

(2) Setting-up and the initiation of the contract.

On the day of delivery the Aquarium will be setup, landscaped and planted to the Hirers satisfaction.

When Springs Aquatic are totally satisfied with the aquariums biological state, fish will be stocked in two stages. This will usually take place on weeks 2 and 6 following the aquariums installation, with the maintenance contract initiating from the second week. The first contract payment will then (week 2) be due and will be payable monthly thereafter.

(3) Payment.

Payment can be made to Springs Aquatic either by cheque on the day the aquarium is serviced or by standing order on the 28th of each month, as agreed at the beginning of the contract.

Any additional costs incurred by the Hirer will be invoiced to the Hirer within 7 working days of the work and will be due within 30 days of receipt, this can be paid by cheque on the next maintenance visit or by post.

If the Hirer decides to make payment by company cheque the cheque must be made available on the day of maintenance, if for any reason the cheque is not available a 10% increase will be added to the amount owed for that month.

All cheques will be made payable to SPRINGS AQUATIC Ltd..

Missed payments will be raised with the hirer as a concern but Springs Aquatic reserve the right to remove, at their discretion, the aquarium following 2 or more missed payments. In such an event the deposit will be used to cover unpaid invoices and incurred costs.

(4) Maintenance contract.

Springs Aquatic will service, clean and maintain all Aquariums on a 4 weekly rota. This may sometimes be more than 6 times in a 6 month contract (12 times in a 12 month contract) but never less. Additional maintenance will be charged at a further £30 if required (at the Hirers request). However, a free call out is available to deal with any issues that arise during the course of the contract.

Springs Aquatic will be responsible for replacing; dead plants, fish and any faulty or warn out equipment as required at their expense – this will be done on the following maintenance visit unless action is deemed, by Springs Aquatic, to be more urgently required.

Springs Aquatic will keep the hirer supplied with fish food, for use with the hired aquarium, as long as the contract continues.

(5) Period of Contract.

Rental Contracts are to be for a Minimum Period of six or twelve months, and will subsequently continue until written notice is received to end the contract. After which the contract will terminate on the next maintenance visit where upon the aquarium will be removed.

A minimum of 4 weeks notice must be given for the termination of the contract.

(6) The Deposit.

A £75 deposit is required on all contracts.

Providing that the Aquarium remains in good order the £75 deposit is refundable at the end of the contract.

(7) The Hirer will.

Agree to all these conditions before the Rental can commence. Keep all Aquariums hired in the condition they were received in and will not allow anyone except Springs Aquatic staff to make repair on any part of Springs Aquatic property.

Give Springs Aquatic staff access to the Aquarium at any reasonable time for inspection, maintenance and, at the end of the agreed rental period, removal.

(8) Ownership.

All Aquariums, the live-stock and accessories hired will remain the sole property of Springs Aquatic at all times.
